Acceptable Sites - We only include family friendly sites of legitimate value. Disallowed sites include ones in languages other than english, adult content, gambling, warez, pharma, hate, or any other illegal or unethical subjects. We disallow pure adsense or banner sites, affiliate sites with little to no unique content, sites under construction, sub-domain sites, and sites that embed deceptive advertising links. One page e-book sites may qualify, but may not be listed in our directory. Acceptance and listing of sites is at our sole discretion.
Site Submission - When submitting a site, you are certifying compliance with our Internet Best Practices. Some requirements may not apply so are met by default, e.g. all credit-card requirements are met if you never process them. Stating false information is a breach of our terms and may result in a permanent ban. If your site is banned, it will say so on the site profile page. Seals will contain alternate content.
Editorial Guidelines - Site titles should be entered in title-case with each word capitalized. The site description should be factual and written objectively. The description should be entered using standard sentence-case and should not contain any html. Submissions with all caps, all lower-case, misleading information or embedded html may not be accepted.
E-Mail Contact - An accurate e-mail address is required in order to submit a site. We will send you periodict announcements of new features when/if they become available, changes to our policies, violation concerns, or to report periodict listings stats.
Seal Placement - Seals are to be displayed visibly on one or more pages of your website using the exact code provided. Only sites logging seal impressions get listed in our directory. It is best to place the seal near the top of the page, above the fold.
Link Code - Seals must be integrated with the exact code provided. Do not make a change without written authorization. We periodically check linked sites for compliance. Non-compliant sites will be removed from the directory or even banned.
Service Marks - All WebEntrust seals are the sole property of WebEntrust, and can not be used other than with respect to the terms found in this agreement. WebEntrust seals must be linked back to us using the exact html link text provided.
Customer Disputes - WebEntrust does not arbitrate disputes between listed sites and their customers. It is up to the site owner to reconcile with the customer. After reconciliation we can send a message to the customer that will allow them to change/delete their comment.
Unique Reviews - A single user is only allowed to create one review per site to make sure that a large number of reviews can't be generated by one person.
Malicious Reviews - We may delete reviews that contain poor language, or that we deem to be malicious without cause.
Directory Listing - Accepted sites are not guaranteed to be displayed in our tag directory. As more sites are added, minimum traffic requirements may be increased. Also sites with a poor average review score will not be listed.
Seal Impressions - Impressions are tracked for unique visitors. Sites that do not generate any impressions will not be displayed in our directory of trusted sites.
Spoofing - We only track unique visitors for a website, not total impressions. Safeguards are put into place to eliminiate any false traffic. Any site found attempting to game their rankings via fake traffic may be removed entirely from the directory.
Disclaimer of Warranties - The WebEntrust seals are provided "as is," with no warranties whatsoever. WebEntrust expressly disclaims to the fullest extent permitted by law all express, implied, and statutory warranties, including, without limitation, the warranties of merchantability, fitness for a particular purpose, and non-infringement of proprietary rights. WebEntrust disclaims any warranties regarding the security, reliability, timeliness, availability, and performance of the WebEntrust seals. WebEntrust disclaims any responsibility for any harm resulting from your use of WebEntrust seals.
You understand and agree that you use the WebEntrust seals at your own discretion and risk and that you will be solely responsible for any damages to your computer system or loss of data that results from the download or use of the WebEntrust seals.
Limitation of Liability - The WebEntrust seals are being provided as is. Accordingly, you agree that WebEntrust shall have no liability arising from or based on your use of WebEntrust seals.
Under no circumstances shall WebEntrust be liable to any user on account of that user's use or misuse of WebEntrust seals. Such limitation of liability shall apply to prevent recovery of direct, indirect, incidental, consequential, special, exemplary, and punitive damages whether such claim is based on warranty, contract, tort (including negligence), or otherwise, even if WebEntrust has been advised of the possibility of such damages). Such limitation of liability shall apply whether the damages arise from use or misuse of and reliance on the WebEntrust seals.
Indemnification - You hereby agree to indemnify, defend and hold WebEntrust, and its officers, directors, agents, licensors and licensees (collectively, the "Indemnified Parties") harmless from and against any and all liability and costs incurred by the Indemnified Parties in connection with any claim arising out of your use of WebEntrust seal, including, without limitation, reasonable attorneys' fees. You shall cooperate as fully as reasonably required in the defense of any claim. WebEntrust reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you.
General Provisions - These Terms and Conditions will be governed by and construed in accordance with the laws of the State of California, without giving effect to the conflict of laws or provisions of California or your actual state or country of residence. Any dispute arising from these Terms and Conditions shall be adjudicated in the federal or state courts located in San Diego, California. If for any reason a court of competent jurisdiction finds any provision or portion of these Terms and Conditions to be unenforceable, the remainder of these Terms and Conditions will continue in full force and effect. These Terms and Conditions constitute the entire agreement between the parties with respect to the subject matter hereof and supersede and replace all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter. Any waiver of any provision of these Terms and Conditions will be effective only if in writing and signed by WebEntrust.
